By accessing and using AppraiserPoint ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

AppraiserPoint is a directory platform that provides information about licensed real estate appraisers across the United States. The Service aggregates publicly available licensing information and allows appraisers to claim and enhance their profiles.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Profile Claims and Verification

Appraisers may claim their profiles by verifying their license information. By claiming a profile, you represent and warrant that:

• You are the licensed appraiser associated with the profile
• All information you provide is accurate and current
• You have the right to use any content you upload to your profile
• Your use of the Service complies with all applicable laws and regulations

5. Subscription and Payments

Certain features of the Service require paid subscriptions. By purchasing a subscription, you agree to:

• Pay all fees associated with your selected subscription tier
• Provide current, complete, and accurate billing information
• Promptly update payment information if it changes
• Allow automatic renewal unless you cancel before the renewal date

Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6. User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant AppraiserPoint a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and promoting the Service.

You represent that you have all necessary rights to grant this license and that your content does not infringe on any third party's rights.

7. Public Information

AppraiserPoint aggregates publicly available licensing information from state regulatory agencies and the Appraisal Subcommittee (ASC). This information is displayed as a public service. We do not guarantee the accuracy, completeness, or timeliness of this information.

8. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Impersonate another person or entity
• Claim a profile that does not belong to you
• Submit false, misleading, or fraudulent information
• Harass, threaten, or harm others
• Scrape, crawl, or use automated means to access the Service without permission
• Interfere with or disrupt the Service or servers
• Upload viruses or malicious code
• Collect user information without consent

9. Intellectual Property

The Service and its original content, features, and functionality are owned by AppraiserPoint and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by AppraiserPoint. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AppraiserPoint does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL APPRAISERPOINT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify, defend, and hold harmless AppraiserPoint and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
